Purpose

Mooncad builds a business with you, by text, in iMessage or WhatsApp: the idea, the name, the logo, the website, then the sales. These terms apply to the mooncad.app website, to your conversations with Mooncad and to the paid plans. By texting Mooncad or paying for a plan, you accept them.

Publisher and seller

Mooncad is published and sold by CADENCE, a French simplified joint-stock company (SAS) with a share capital of €100, registered with the Paris Trade and Companies Register under number 107 882 250, whose registered office is at 11 bis rue de Maubeuge, 75009 Paris, France. EU VAT number: FR54107882250. Publication director: Martin Mosoiu. The website is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, USA.

What Mooncad does

Mooncad is a young service and what it does keeps changing. Before every payment, the conversation tells you what is included. The brands shown on the website are examples.

Work done with artificial intelligence

Mooncad writes, designs and codes with artificial intelligence models. Its suggestions may contain mistakes: check names, texts, prices and figures before you use them. The market study cites its sources, but it does not replace your own checks. Mooncad does not give legal, accounting or financial advice, and promises no sales figures.

Your name, your .com and your brand

Mooncad checks that a .com is available and looks for existing trademarks under that name, but cannot guarantee it. Before you register the name as a trademark, set up your company or invest, check it yourself, for example with the USPTO, the EUIPO or your national office. Mooncad does not register trademarks or companies for you. If you want your .com, you buy it yourself; Mooncad can then connect it to your website.

What belongs to you

The name, logo, texts, images, website and app Mooncad creates for you are yours: you may use, change and exploit them freely for your business. You also keep your rights to what you send Mooncad; you only allow it to use that to do what you ask. Your logo and images are sent to you in the conversation: keep them.

Your website, your sales and your payouts

With Launch, your website is online at mooncad.app/s/your-name, or on your own domain, and your app at your-name.mooncad.app. Your customers' payments are processed by Stripe. CADENCE is the seller of record for sales made on your website and in your app: it collects the payment, handles the sales tax, then pays you your share.

Mooncad takes no commission: you receive the amount of each sale, minus Stripe fees and taxes, in your Stripe payout account, which you open from the link sent in the conversation. For a service, the payout goes out 48 hours after you tell Mooncad it's done.

Clothing is made to order by Printful. With each sale, Mooncad sends you a link to pay for production; if it is not paid after two links, the order is cancelled and your customer refunded. Mooncad never advances money on your behalf.

You remain responsible for what you sell: your products and services, their description, their prices and their compliance with the law. You agree to deliver what you sell, to provide the service promised, to answer your customers and to declare your income.

Nothing without your OK

Mooncad never spends money on your behalf and never posts on your social accounts. Grow's ads are ready to post: you post them on your account and you pay Meta. Night work (a new product, a newsletter, a website tweak) is only applied after your yes. A quote request is only sent to manufacturers after your yes, with the email address you gave, and Mooncad never orders anything from a manufacturer. What you ask for by text, such as changing a text, a price or connecting a domain, is done right away.

What is not allowed

You may not use Mooncad to sell or promote anything illegal, counterfeit or dangerous, to mislead your customers, to copy someone else's brand, or for hateful, violent or sexual content. Mooncad may refuse a request, remove a product or close a website that breaks these rules or the law.

Payment, changing plans and cancelling

Launch and Grow are monthly subscriptions paid by card through Stripe; Mooncad never sees or keeps your card numbers. The first month is charged when you subscribe, then every month on the same date.

To move from Launch to Grow, Mooncad tells you the exact amount before your yes: the difference for the current month is charged right away. If you go back to Launch, nothing is refunded and Grow continues until the end of the paid month.

There is no commitment. You can cancel at any time, at no cost, from mooncad.app/abonnement: enter the email address used for payment, then choose “Cancel subscription” in the link you receive. You can also write to us from the Contact page. Cancellation takes effect at the end of the paid month; your website and app then go offline.

For 14 days after your first Launch payment, you can ask for a full refund of that first month from the Contact page, with no reason needed.

Availability

We do our best to keep Mooncad and the websites and apps it creates online, and the information on this site accurate, but cannot guarantee it. The service may be interrupted or changed at any time; if a change affects your subscription, we tell you in the conversation.

Intellectual property

The Mooncad name, its logo and the texts and images of mooncad.app are protected. Any reproduction without permission is prohibited.

What Mooncad does with your data is described in the privacy policy.

Governing law

These terms are governed by French law. If you are a consumer, you keep the protections the law of your country gives you.
